You're watching The Legal Breakdown.Glenn, we have such a shocking update that I couldn't believe it when I read it.Can you explain what Donald Trump's lawyers just requested of E. Jean Carroll's attorneys in the aftermath of the Supreme Court refusing to review the $5 million judgment that she won?

0:18

Brian, Donald Trump's lawyers had the nerve, had the gall to ask E. Jean Carroll's lawyers, now that the case is dead, it's over and Donald Trump lost, and he is to pay E. Jean Carroll $5 million plus interest. They just asked E. Jean Carroll's lawyers if she would consent to Donald Trump not paying her the $5 million plus interest. And apparently Donald Trump's lawyers are, you know, ruminating whether they might want to try to file a motion to reconsider with the Supreme Court, which is just absolutely absurd. And the good news is, E. Jean Carroll's lawyers, including Roberta Kaplan, the lead lawyer, shot back, no, E. Jean Carroll does not consent. It is time.to pay up.

And interestingly, Brian, there's actually a court filing back in June of 2023, where the parties agreed, Trump's lawyers and E. Jean Carroll's lawyers agreed that he could hold off paying her the $5 million as long as interest continued to accrue until such time as the Supreme Court denies a petition to hear the case. And the Supreme Court just denied his petition to hear the case. And the gall of Trump's lawyers to say, well, even though that's what we said and what we filed with the court back in 2023, we would like her to consent to, you know, not being paid for an additional time. And no, E. Jean Carroll is not consenting. In fact, they're asking for an accelerated date to have the court disperse the money that has basically been paid into sort of a court escrow account to satisfy the $5 million judgment while the case was working its way forward.

through the appellate process.

2:45

single piece of content, but this is the one time that I'll ask for some support for a book that I really think meets this moment.to include in the reporting about this because, of course, E. Jean Carroll not consenting is the whole basis of this thing. And so what worries me here is that Donald Trump is going to hear that and not listen because that seems to be a recurring theme as it relates to Trump and E. Jean Carroll.

3:20

Yeah, I mean, Donald Trump is clearly a sore loser and he refuses to accept a loss that was delivered to him first by a jury of his peers in New York, second by a court of appeals, and now third by the United States Supreme Court that he often refers to as his Supreme Court.Of course, they've been ruling against him a little bit more frequently in recent days and weeks. So, you know, it's not a surprise that Donald Trump continues to sort of not make good not only on his promises,as I mentioned back in July 2023 when the parties agreed that he would pay up when the Supreme Court refused to review the case, but he's not making good on his debts and he's not accepting the sort of lawful jurisdiction of the court now that he has definitively lost and the case is over. You know, if there's a little bit of good news, it is that E. Jean Carroll's lawyers a couple of years ago said, you know what, we will hold off trying to collect until the Supreme Court refuses to review the case as long as interest continues to accrue. So guess what Donald Trump owes now?

4:31

Not just the $5 million that the jury awarded E. Jean Carroll and ordered him to pay, but I think with interest, it's now up to almost $5 million and almost $780 ,000, pushing $6 million. And I have to believe that Donald Trump has finally reached the end of the line, and he will have to make good on that money judgment that the jury ordered him to pay.

4:57

Glenn, can you help me understand why Trump's team thought that this is something that Roberta Kaplan and E. Jean Carroll's team would ever agree to?Like, on what grounds, after Donald Trump has dragged this out for years?I believe this judgment came, if I'm not mistaken, in 2023.It's now 2026.He's used every avenue he could, every dilatory tactic that he could, to prevent himself from having to pay.Why would they think that E. Jean Carroll's team would be amenable to this?

5:30

I'm going to draw a reasonable inference here, which is what we prosecutors do.We look at the available facts, the evidence, and we draw reasonable inferences. So when you ask, you know, why in the world would Donald Trump's legal team make this really absurd, if not obscene and depraved request, I have to believe, I have to infer, Brian, that this is not the attorney's choice. This is the client demanding something that is unreasonable, indeed laughable. And, you know, good lawyering involves pushing back on your client when they do something that really has no good faith basis in fact or in law.

6:10

But, you know, some attorneys are weak and they are forever kowtowing to an unreasonable client. So I have a feeling this is Donald Trump saying, I'm not going to pay and you all need to file something in court, making it clear that I'm not going to pay or at least continuing to delay this until I can come up with some other scheme to wriggle out of paying what a jury ordered I pay to E. Jean Carroll.

6:38

You know, I think what's especially interesting, and you alluded to this before, is that Trump will bend over backwards to prevent himself from having to pay a single cent if he can help it.And yet at the same time, this guy is fleecing the federal government and the American people for every dollar he can get.I'm going to read a quick rundown based on his latest financial disclosure of how much money this populist champion Donald Trump has made.$294 million from World Liberty Financial Token and Stablecoin sales. That's a crypto venture that he co -founded with his sons.$65 million from selling equity in that same company.

7:19

$80 million from media settlements from ABC, CBS, Meta and YouTube. His total crypto haul was over $1 .4 billion in a single year. And his net worth has tripled from $2 .4 billion to $6 .3 billion. And this motherfucker won't pay $5 million that he has owed E. Jean Carroll based on that judgment that he's owed her as of three years ago.is still doing everything he can to make sure that he doesn't have to pay a single cent. This guy will fleece Americans for every dime he can get, but not spend a single dime of his own money if he can help it.

7:56

With apologies to motherfuckers. And I know you know that that feels like an irreverent thing to say.But Brian, this man has profited off the presidency in a way that is at a minimum horrifically unseemly and obscene and depraved.Come January 2029, when the rule of law is again a thing, these matters must be investigated to see if all this grifting and profiteering off of his office violates any of our nation's laws. And I am betting that a full, fair, aggressive, apolitical investigation into what Donald Trump is doing to the American people may very well disclose criminal conduct. But as you say, he's making billions and billions of dollars because a small fraction of the population decided to vote for him for president.

8:54

So once you're a multi -billionaire, it would seem to me that five or six million is something you can probably find in the couch cushions in one of his gold -plated apartments in Trump Tower. And it really is absurd.and just obscene that he is not paying what a jury ordered him to pay because that jury found that he sexually assaulted and defamed E. Jean Carroll.

9:21

Last point here, and I want to dig into something that you just said, because I think this is important. And it's actually something that I bring up in my new book, The Day After, which is coming out in a couple of weeks. So for folks who would like to support my work, I would humbly ask that you pre -order it.I'm going to put a link in the post description of this video.pre -order.But just this idea of accountability for people who are committing criminal acts right now.

9:46

Obviously, we didn't see that in between Trump 1 .0 and Trump 2 .0 because Merrick Garland decided to do whatever he could to prevent the optics of politicization. But as we see these financial crimes and this grifting to the degree that it's taking place right now, it, you know, and we see almost on a daily basis some announcement that sends the stock market up or down. But we find out later in the day that there was all this trading activity just a few minutes earlier before the announcement came out.I mean, there's so much insider trading happening. There's so much grift, graft and corruption happening on a daily basis that it would boggle anybody's mind.Is this something that the next administration would still have grounds to investigate and possibly prosecute given the amount of time that's going to pass.

10:38

Would this still fall under the statute of limitations?Absolutely.

10:42

The shortest time frame, the most short -fused statute of limitations for federal crimes is five years.Everything Donald Trump has been doing during this presidential term will be well within the statute of limitations for at least a year once Donald Trump falls from power, assuming he makes it to the end of his term and he's not you know, removed either for unfitness or he's impeached or, you know, he is otherwise unable due to health reasons to continue in the presidency. So, yeah, I can't tell you how enthusiastic many of us who were career civil servants, public servants as federal prosecutors and serving in other ways were are looking forward to being part of the cleanup mission, the accountability mission, come January 2029.And when people say there's too much crime that has been committed by Trump and his criminal associates for us to get our arms around, shouldn't we just turn the other cheek and, you know, put it all behind us?And I say, you know what, there's actually too much crime.for us not to get our arms around and hold these people accountable for what they have done to American democracy and for victimizing the American people day after day after day in so many ways that violate our nation's laws.
