Rahul Gandhi said that it was surprising to say that the election commission destroyed the CCTV footage. Because the question about the Maharashtra elections were already being questioned. The election commission said that Maharashtra had a massive voting turnout after 5.30 pm.

But Rahul Gandhi said that our people were standing on polling booths. Nothing of that sort had happened. The election commission says that there was a massive voting turnout at 5.30 pm. But no district officer published its deletion report. Friends, ensuring fairness and transparency in elections is the job of the Election Commission. But they are doing the exact opposite. In June 2023, the Election Commission issued a directive to the Chief Electoral Officers of Chhattisgarh, Madhya Pradesh, Mizoram, Rajasthan and Telangana that the voter modifications that took place between January and June should not be published. Think about it. Normally, a directive is issued to publish the voter modifications. But here, an order is being given not to publish it. When Indian Express contacted the State Election Commission regarding this,

they refused to answer these allegations. And here, it's also very interesting that what did the BJP leaders answer in reply? With this, Madhya Pradesh's BJP leader Vishwas Sarang said, that why has Congress woken up from sleep after 20 months of Assembly elections? When the election results have been declared, you have to challenge them within 45 days. And that doesn't happen through press conference.

For that, you have to file an election petition. He has said it right here. If there is any problem in election results, then within 45 days of the results being declared, you have to file an election petition in the court. Its provision has been given in our Constitution in Article 329.

It also has a specific law, Representation of the People Act, 1951. Its Section 80A specifies that its jurisdiction is with the High Court. Whereas in Section 116A, it is specified that in the case of election petition,

the judgment of the High Court can also appeal against the judgment of the High Court. It is also important to specify that the elections of the President and the Vice President are completely different. If there is any doubt or dispute regarding them, the matter goes straight to the Supreme Court. Its provision is in Article 71 of the Constitution. And its procedural details are in the Presidential and Vice Presidential Elections Act, 1952. But if we come back to our point,

the Election Commission's job is to prepare for the electoral rolls and conduct the elections. When the elections are going on, no court intervention is made at that time. And if someone sees anything wrong at that time, then he can complain to the Election Commission.

When the elections are held and the result is declared, the Election Commission cannot review the results. Now, the High Court gives the Election Petition. So, BJP leader Vishwas Sarang is right. But the Election Petition should not be given in the air. It should have some evidence. Evidence is also needed.

And the problem in our case is that the Election Commission has a horoscope on the evidence. Then how will the discussion proceed? Where voting is taking voting, neither a phone nor a camera can be taken. So how can anyone collect evidence? The evidence is only present in the CCTV footage which is used to destroy the Election Commission. Mr. Vishwas, when your name is Vishwas, then you should also try to spread faith in democracy.

If you think that BJP is popular among the public, then you should give an open popular among the people, then you should challenge the Congress. If you want to run for election, then do it. Tell the Election Commissioner who to elect. Tell him which CCTV footage to publish. Tell him the date of the election.

You will have full transparency. Then you can say that we won and the Congress won't have any excuse to lose. But again, BJP is not doing this. Actually, BJP's actions are the opposite of this. It said that for the appointment of the Chief Election Commissioner and Election Commissioners, a high-powered selection committee should be formed. In which the Prime Minister, Leader of Opposition and the Chief Justice of the Supreme Court would be present. These three people should vote together and decide who will be the Election Commissioner. It is a very logical judgment because the Election Commissioner should be impartial.

So it makes perfect sense that to elect him, there will be a Prime Minister, a Leader of Opposition, a balance is made here, and a Chief Justice of India. But in December 2023,

what did the government do? It bypassed this judgement by passing its own law. The government said that the Chief Justice should be removed from this committee and a new Union Cabinet Minister should be appointed. This resulted in two people from the government and one from the opposition and the balance was ruined. Now the government can appoint an election commissioner of its own accord.

Many petitions have been filed against this in the Supreme Court. Like Jaya Thakur v. Union of India. But the Supreme Court has refused to put a stay on this. In this same law, the government has cleverly added one more thing. That any Chief Election Commissioner or Election Commissioner, while doing his official duty,

no matter what he says or does, against him, in any court, there can't be any civil or criminal proceedings. It is true that while doing official work, anyone can make a mistake. And that's why the scope of the mistake should be maintained.

But if an Election commissioner is deliberately cheating, stealing votes, and putting a dent on democracy, and if there are evidences against this, still a case cannot be filed against him. What logic is this?

Once again, use your common sense. No need to ask the IAI again. Why would any government want to do this? Under this same law, friends, Gyanesh Kumar was appointed as the Chief Election Commissioner. Narendra Modi and Amit Shah were present in the committee to appoint him.

Rahul Gandhi was also there. But there is a vote of 2-1. And today, questions are being raised on this same Gyanesh Kumar. He himself has sat on the machine-readable voter list and CCTV footage. And then he comes to the press conference and shouts, Where is the evidence? Bring the evidence. All the evidence is in their pocket. Why don't they show it to the public?

There is no evidence. There is no proof.

This CCTV footage went viral because it was public and this vote was stolen. Later, the Supreme Court directly said that this is a murder of democracy. Anil Masiya was also asked to prosecute under Section 340 of CRPC. After this, the Supreme Court declared

the mayor of Chandigarh to the councillor of AAP, Kuldeep Kumar. This is not an isolated case, friends. Something similar happened Two weeks ago, a similar incident happened in a village in the Panipat district of Haryana. Kuldeep Singh was declared the winner of the Panchayat elections. But the other candidate, Mohit Kumar, saw that there was a problem with the vote count. He complained to the court.

The legal battle went on for 33 months. The case reached the Supreme Court. The EVM was called, the Supreme Court Registrar counted it again and it was videographed. And finally, do you know what the result was? The Supreme Court overturned the election result and said that actually, Mohit Kumar won these elections.

Now, look at the case of Bihar. There too, the same thing is happening with the SIR. SIR means Special Intensive Revision of Electoral Rolls. BJP supporters are saying that if votes are stolen according to Rahul Gandhi, then SIR is a very good thing. I'll also say, friends, it's true. SIR is a very good thing because it can remove the mess of electoral rolls.

But the problem here is that this SIR is not happening properly. Instead of removing the mess in electoral rolls, the mess is increasing. The living people are being declared dead on the voter list. And the dead are being called alive. Journalist Tamal Saha has put a video in which the photos of Bhasu Singh and Krishna Devi are visible on the wall behind him.

Both of them have passed away 8 years ago. The information about this has also been given. But still, their name is still present in the draft voter list. The draft list of the Election Commission has the names of these two.

but their names are still there. Whereas, Bhasu Singh's son Dilip, who is still alive his name is missing from the voter list.

His name has been removed from the voter list. Yogendra Yadav reached the Supreme Court regarding this matter. Where the Bihar's SIR was challenged. Yogendra Yadav took two people with him. Who were removed from the voter list by calling them dead. He went to the court and said, Look at these people, they are alive.

They have been declared dead in the voter list revision. They don't even has no name. Rahul Gandhi had tea with such people. He put a video on YouTube titled Tea with the dead. Thanks to the Election Commission.

If the names of 65 people are being removed in a wrong way, then too this is a burden on democracy. Because these people are not sheep and goats. Even if they are poor, illiterate, but they are also Indian citizens. They also have the right to one person, one vote. In fact, such people have only one vote, their power. And you are taking that away from them. Gyanesh Kumar has made a spectacle of the entire election process.

Look at the report of the Reporters Collective. 509 voters from different families, who are from different castes and communities, all of them are registered in the Pipra constituency, in the same house in the Galeempur village. I agree that there is communalism in the country,

there is casteism, but that doesn't mean that the Election Commission in the name of unity and diversity, let 509 people enter the same house. And this joke is not over yet. The punchline of this joke is that this house does not exist. There is another house of dreams of the Election Commission where 459 people have been registered.

Pipra, Bagaha, Motihari. In just these three assembly constituencies, 3590 such cases have been found where more than 20 people have are registered on the same address. In many of these cases, there is no home. In total, in these 3 constituencies, 80,000 such people have been found.

In the Amin village of Jammu district, more than 200 people have complained to the district administration that the same address of all of them has been given. Ward number 3, House number 3. Now, there are questions about an affidavit, why isn't he being asked for the same by Anurag Thakur? He also said that there is some voter fraud going on, he accused Congress, but Gyanesh Kumar doesn't think it's necessary to ask him for an affidavit.

If someone has deliberately lied in the evidence, then a case of perjury can be filed against them.

The Election Commission is a constitutional body. Like the former Chief Election Commissioner who is respected for election reforms. T.N. Sheshan had said that I am not the Chief Election Commissioner of the Indian government.

I am the Chief Election Commissioner. It doesn't make a lot of difference that I'm not the Chief Election Commissioner of the Government of India. But I'm the Chief Election Commissioner of India.

That's a very minor change in emphasis. That's why when the Constitutional body is responsible for the elections, people can complain about any mistakes in the elections. They can take action while investigating. This is how the Election Commission has a quasi-judicial role. So here comes the issue the affidavit.

The logic is to ensure that the complaint is genuine and there is correct evidence. When a candidate files his nomination for the election, then the affidavit has to be submitted. Which is an essential requirement. But the thing is that an affidavit is not necessary when a complaint is filed. Secondly, the data that Rahul Gandhi has exposed,

is taken from the Election Commission is the same as the data given by Rahul Gandhi. Now, how correct and how not, can the Election Commission shift this responsibility to Rahul Gandhi? The evidence presented by Rahul Gandhi, Gyanesh Kumar took it to his press conference and there was no question raised. And the most important thing is that Rahul Gandhi has not only accused the BJP but also the Election Commission. That both of them together committed the theft. Friends, not only BJP but also the Election Commission has been accused of stealing. The principle of natural justice says that if someone is accused, he cannot be the judge of the matter.

In this case, the Election Commission has no moral right to ask for an affidavit. In fact, it is their moral responsibility towards the people of the country. Prove yourself innocent, restore people's trust or resign. But the problem is, who takes moral responsibility in today's world? In this case, the impeachment motion of the India Alliance against them will be a logical step. And when BJP has talked about voting, they should support this impeachment motion.

If voter fraud is happening, remove the election commissioner. But you can easily guess that this is not going to happen. BJP will try its best to save Chief Election Commissioner Gyanesh Kumar.
