For that, you have to file an election petition. He has said it right here. If there is any problem in election results, then within 45 days of the results being declared, you have to file an election petition in the court. Its provision has been given in our Constitution in Article 329.
It also has a specific law, Representation of the People Act, 1951. Its Section 80A specifies that its jurisdiction is with the High Court. Whereas in Section 116A, it is specified that in the case of election petition,
the judgment of the High Court can also appeal against the judgment of the High Court. It is also important to specify that the elections of the President and the Vice President are completely different. If there is any doubt or dispute regarding them, the matter goes straight to the Supreme Court. Its provision is in Article 71 of the Constitution. And its procedural details are in the Presidential and Vice Presidential Elections Act, 1952. But if we come back to our point,
the Election Commission's job is to prepare for the electoral rolls and conduct the elections. When the elections are going on, no court intervention is made at that time. And if someone sees anything wrong at that time, then he can complain to the Election Commission.
When the elections are held and the result is declared, the Election Commission cannot review the results. Now, the High Court gives the Election Petition. So, BJP leader Vishwas Sarang is right. But the Election Petition should not be given in the air. It should have some evidence. Evidence is also needed.
And the problem in our case is that the Election Commission has a horoscope on the evidence. Then how will the discussion proceed? Where voting is taking voting, neither a phone nor a camera can be taken. So how can anyone collect evidence? The evidence is only present in the CCTV footage which is used to destroy the Election Commission. Mr. Vishwas, when your name is Vishwas, then you should also try to spread faith in democracy.
If you think that BJP is popular among the public, then you should give an open popular among the people, then you should challenge the Congress. If you want to run for election, then do it. In which the Prime Minister, Leader of Opposition and the Chief Justice of the Supreme Court would be present. These three people should vote together and decide who will be the Election Commissioner. It is a very logical judgment because the Election Commissioner should be impartial.
So it makes perfect sense that to elect him, there will be a Prime Minister, a Leader of Opposition, a balance is made here, and a Chief Justice of India. But in December 2023,
what did the government do? It bypassed this judgement by passing its own law. The government said that the Chief Justice should be removed from this committee and a new Union Cabinet Minister should be appointed. This resulted in two people from the government and one from the opposition and the balance was ruined. Now the government can appoint an election commissioner of its own accord.
Many petitions have been filed against this in the Supreme Court. Like Jaya Thakur v. Union of India. But the Supreme Court has refused to put a stay on this. In this same law, the government has cleverly added one more thing. That any Chief Election Commissioner or Election Commissioner, while doing his official duty,
no matter what he says or does, against him, in any court, there can't be any civil or criminal proceedings. It is true that while doing official work, anyone can make a mistake. And that's why the scope of the mistake should be maintained.
But if an Election commissioner is deliberately cheating, stealing votes, and putting a dent on democracy, and if there are evidences against this, still a case cannot be filed against him. What logic is this?
Once again, use your common sense. No need to ask the IAI again. Why would any government want to do this? Under this same law, friends, Gyanesh Kumar was appointed as the Chief Election Commissioner. Narendra Modi and Amit Shah were present in the committee to appoint him.
Rahul Gandhi was also there. But there is a vote of 2-1. And today, questions are being raised on this same Gyanesh Kumar. He himself has sat on the machine-readable voter list and CCTV footage. Something similar happened Two weeks ago, a similar incident happened in a village in the Panipat district of Haryana. Kuldeep Singh was declared the winner of the Panchayat elections. But the other candidate, Mohit Kumar, saw that there was a problem with the vote count. He complained to the court.
The legal battle went on for 33 months. The case reached the Supreme Court. The EVM was called, the Supreme Court Registrar counted it again and it was videographed. And finally, do you know what the result was? The Supreme Court overturned the election result and said that actually, Mohit Kumar won these elections.
Now, look at the case of Bihar. There too, the same thing is happening with the SIR. SIR means Special Intensive Revision of Electoral Rolls. BJP supporters are saying that if votes are stolen according to Rahul Gandhi, then SIR is a very good thing. I'll also say, friends, it's true. SIR is a very good thing because it can remove the mess of electoral rolls.
But the problem here is that this SIR is not happening properly. Instead of removing the mess in electoral rolls, the mess is increasing. The living people are being declared dead on the voter list. Which is an essential requirement. But the thing is that an affidavit is not necessary when a complaint is filed. Secondly, the data that Rahul Gandhi has exposed,
is taken from the Election Commission is the same as the data given by Rahul Gandhi. Now, how correct and how not, can the Election Commission shift this responsibility to Rahul Gandhi? The evidence presented by Rahul Gandhi, Gyanesh Kumar took it to his press conference and there was no question raised. And the most important thing is that Rahul Gandhi has not only accused the BJP but also the Election Commission. That both of them together committed the theft.
